It does raise an interesting legal question. If a statutory instrument is revoked which has revoked some earlier legislation, does that mean the original legislation is now un-revoked?!

A repeal of legislation apparently has the effect of ‘to obliterate it completely from the records of Parliament as though it had never been passed.’ So revoking legislation which revokes earlier legislation does not reinstate that earlier legislation! Unless some provision for saving part of it has been made or replacing it with some other legislation. See http://en.wikipedia.org/wiki/Repeal for an intro to the subject.

Not so much "cutting red tape" as taking on that rainy day job of clearing out the dusty attic. These old Regs could have languished on the Statute Books ad infinitum without causing any upset. I do suspect that this frankly meaningless task will all count towards this incessant numbers-game being plied by the Government. I'm sure the HSE would agree there's better things they could be doing.

I came across an oddity a few years ago - cannot find it now but it was to the effect "under these circumstances the requirements of SI xx continue to apply as if that SI had not been revoked".
