Posted By Paul Garner As safety manager I need to be sure of our obligations for the below scenario: My company has recently purchased a concern in Holland. The new acquisition will be wholly owned bu us, controlled by UK management but the original staff will be kept in place to provide continuity. What are our obligations in respect of H&S to this acquisition? How far reaching will these obligations be? Any ideas?

Posted By Merv Newman Paul, effectivly, you will be owning and operating a company located in holland. That company must conform to all relevant dutch legislation, including HSE. Example : if an employee of the dutch company is injured while visiting your premises in the uk, his employer, the dutch company, could be held liable under dutch legislation. depending on the circumstances, your english company, as landlord of the premises, could also be held liable under uk legislation.
