Posted By andy.c. Opinions, clarification please,
IP has minor accident on Wednesday, stays at work until end of working day. Reports in sick on the Thursday stating accident from previous day for absence, has rest days Friday and Saturday and returns to work on the Sunday.
Not counting the day of accident but including rest days this is a three day absence and therefore automatically reportable, but if the IP during a back to work interview implies they only needed a day to rest and had it not been a rest day (Friday)would have attended work, should i still report
Regards Andy

Posted By Paul Duell Agree with Steven N: It's not whether they were AT work, it's whether they were FIT to work.
Otherwise, every accident including cuts and bruises, on the day before you go on a fortnight's holiday, would be reportable!

Posted By Clive Lowery Hi Andy,
I would say no. The important fact is that the IP was available for work.
However; that said I would record all the details and keep a note in their file, ensuring they signed a statemnt to that effect as well.

Posted By Richard Altoft Don'T disagree with the others but in any case not reportable as must be OVER 3 days not fit for normal duties and not simply 3 days, not counting day of accident to be reportable unless it was a specified injury etc. R

Posted By safetyamateur Even without the 'Friday' issue, this is a two-day absence, right? (exclude day of incident, Friday & Saturday absent, work on Sunday = 2 days)

Posted By anon1234 Richard Altoft is correct - it is NOT reportable as the IP was only absent for a maximum of 3 days not including the day of the accident - hence it is not an OVER 3 day RIDDOR.

Posted By Phil Rose Others have beaten me to it - it's not a 3 day injury that is reportable it's an OVER 3 day injury. Also remember that it is not just limited to injury's which result in people being off work for more than 3 days but also those injury's that mean that people are unable to perform their NORMAL work duties for more than 3 consecutive days.
Paul D - "every accident including cuts and bruises, on the day before you go on a fortnight's holiday, would be reportable" - they may well be recordable, but not necessarily reportable under RIDDOR.

Posted By Peter F Paul D,
they would have to state that the accident was the reason they were off i.e. cut finger and as it would be over the stat, 7 days produce a doctors note.

Posted By Biggles473 I wonder then why we persist with the "3 day" comments. It's always baffled me as it's got to be 4 days minimum...who thought this up in the first place...HSE?
Surely we should be calling it a 4 day or more injury / absence.
Just a thought.
