Finally, and something like a year overdue, the SGC have published guidance on CM sentencing. This guidance has somewhat predicatably been watered down from the original proposal based on the turnover of the organisation. Whilst I can see the merit in not basing a pecunairy sanction solely on company turnover, I fear that fines will also be greatly reduced. The maximum fine for a h&s offence (HSWA) stands at £15m handed to Transco (Scotland) whilst we often see fines many times that amount for financial impropriety and competition infringements. Let's hope the courts now give meaningful fines for CM, although for non-profit making organisations such as Borough Councils, Hospital Trusts, Police Forces and so on, the fines will be greatly reduced.
