International Evaluation of Compliance for 18k1

Does anyone have a checklist for use against the local legislative requirements in the following territories? I need to be able comply with the 18001 Evaluation of Compliance requirement so any help will be great....

Isn't your accredited SMS transferable as is? BSI tell us that BS OHSAS 18001 is an internationally recognised standard.

Hi Ron
Yes - the SMS is transferrable, however, there are not consistent legislative requirements across each country. For instance, we have over 300 pieces of H&S law in uk but only 9 exist within Nigeria. Thus, to demonstrate Eval of Compliance within each location is not a simple transfer........

I hope you'll forgive my uninformed & humble questions here, but isn't the accreditation about the SMS, i.e. the system in place to manage occupational health and safety risk potential within the business, the efficacy of which is not at all dependant on the existence (or otherwise) of specific Legislation? I had thought that this was the whole point of having an internationally recognised Standard?

In brief the standard is designed to encourage management buy in, promotion of good practice leading to contineous improvement, and therefore safe workplaces. It requires the business to be aware of legislation and not to breach it, it also requires the business to remain up to date with legislative changes.
My own view is to favour a management system that lays out the best practice position, i.e the business will assess hazard and risk, the business will issue PPE appropriately, it will manage risks associated with change etc, etc. Each aspect effectively generating a top level best practice document which applies across the business informing managers etc how to achieve the best practice position while ensuring they check they meet local legislative need where legislation exists.
Remember just because there isn't a law for it doesn't mean it's safe to do it, hence spreading best practice across the business as a way of countering gaps in the law.
