Hi All,

I want to clarify something regarding a company site van please. This van is used in a manufacturing facility, mainly by maintenance lads, and may occasionally be driven on a jetty that is within the site boundaries, so it never operates on public roads. What are our obligations in this situation? Do we need to carry out a pre-use check (I assume not), and what about regular servicing? Since this is in Ireland, I assume we are not required to have an NCT (equivalent to an MOT in the UK).

  • Pre-use checks

    • Not legally mandated daily like road vehicles, but a proportionate system of inspection must exist.

    • This could mean a weekly check, or a checklist system for tyres, brakes, steering, lights, etc., depending on risk.

    • If the van is only lightly used on private grounds, daily driver walk-arounds may not be strictly necessary—but some form of regular inspection is advisable.

  • Servicing & Maintenance

    • Yes, you must have a planned preventative maintenance regime, carried out at reasonable intervals, in line with manufacturer recommendations.

    • Keep maintenance records (HSA inspectors often request these).

  • NCT (MOT equivalent)

    • Not required, since the van never goes on public roads.

    • However, if at any point it were to be driven on a public road, even briefly, it would need a valid NCT, road tax, and insurance.

  • No NCT is required if the van never leaves the site.

  • Pre-use checks are not strictly mandated daily, but under Irish health and safety law you must have a system of inspections and maintenance appropriate to the risks.

  • Regular servicing and record-keeping are required under SHWWA 2005 and the 2007 Work Equipment Regulations.

  • Treat the van as work equipment, not a road vehicle, but ensure it is maintained to prevent accidents.

Not used as a road vehicle but still work equipment and so requires a risk based level of inspection and maintenance which might well include pre use checks  and servicing.  Do you envisage that all maintenance  will be on site or might you ever need to take it to a garage?

It has gone off-site once before, it was collected on a flatbed and had work done, that is once in about 15 years since it is here! Hasn't seen a service in about 9 years now. Some look at it and act as if it's fine as it's parked up most days of the week, it may get 1 hour of driving a week, probably less.
