I am looking into landlords responsibilities for fire safety in Common Area (risk assessments) Has anyone came across Section 93 of the Civic Government (Scotland) Act 1982 empowers the “fire authority” (the Scottish Fire and Rescue Service) to take action in certain circumstances where fire security in common stairs, such as those in tenement buildings or flat complexes, is infringed.

Has anyone seen this actioned to force the landlord to do a fire risk assessment

I think there may be some confusion here. The duty to risk assess regarding fire safety is contained in section 53 of the Fire Scotland Act 2005.

The Civic Government (Scotland) Act 1982 deals with occupiers (could be landlord or employer but may be any occupier) - so for example, you buy a ground floor flat and block off the emergency exit to the rear of the comunial area, then the SFRS could take action on the occupier and not the landlord (how could the landlord know). I have never heard of any such action though.
