I haven't encountered this with IOSH, but I have had information on how this works elsewhere (a university).  The answers to an assignment are run through a piece of software that gives a percentage score for how similar they are both to each other and to internet sources.  However the software itself cannot come to a conclusion of plagiarism.  The similar text it picks out is highlighted along with a reference to what it is similar to and then a human being has to look at it and apply an algorithm called common sense.  If the similarity is just due to use of relevant technical terms or quoting key passages such as legislation, as in your case, then all will be well even with a high similarity score.

I remember the question was about having received a result of a pass for an IPD submission, with the caveat that there was a certain percentage of similarity which was going to be investigated.

I apologise for the confusion, I  removed my earlier post. The question was regarding similarity percentage on my feedback on Part B of IPD. Part A of the question required a lot of legislation  quotes’ within the answer and with only 700 words it was a very difficult task to give a full explanation or even elaborate on my answer.

Fortunately following review they are satisfied with the answer and have passed me!

CPD audit and Peer Review here I come!
