Hi,

Can anyone assist with a either a template or the wording for a letter offering night shift workers annual health screening/medical? Not something I have had to provide previously but trying to assist a customer on this. Looked online but am not able to find anything suitable.

Is this a "first foray" on night shift working for this employer or a follow up on work already started?

Dependent upon the above it could be the letter is going to need to state why the surveillance is occurring, what is being monitored and what happens if the resuts are not as anticipated / expected which then crosses in to what do the current contracts of employment say and what will future contracts say.

Even a follow up surveillance needs to consider that eventually employees will cease being fit enough for the rigours of night work - are there suitable plans for a step back to day working or is the option discarded to the scrap heap?

The absence of responses on this forum likely arises that your quest falls more in to the area of employment contract than strict H&S.

Hi,

Thanks for your reponse. The customert has been conducting surveillance for some time but a change in personnel has left them without documents, including what should be in the letter offering surveillance.

The customer has an appointed Employment/HR company but they state that this is a H&S issue and are not assisting with the letter content.

Interesting that the letter should vanish due to personnnel change. The customer may wish to write to the person involved and remind them that anything created during the course of their employment actually belongs to the employer unless specifically agreed in writing as being otherwise.

This HR firm sound like quite a poor example (template contracts of employment).

My advice would be to step away from this enquiry. You may resolve the letter content query but there are so many contractual issues that could be thrown up that need competent employment law review.

Hi John

I could draft something along the lines that you set out in less than 10 minutes, but probably so could you.

Would it hold water, should some problem come up in 5 years time and you are in the witness box in an Employment Tribunal? Probably not.

This is one for people who deal with HR issues, possibly with some ADVICE from an OSH professional.

I am genuinely interested in which UK employment law you are referring to.

The Working Time Regulations say "Employers must offer workers a free health assessment before they become a night worker. Workers do not have to accept."

Yes, I understand what the Working Time Regs and asssociated guidance say, but these do not sit in isolation.
