Farrell,

PUWER doesn't just come into something if there is a fault; if PUWER is involved then it is work equipment; if it is equipment provided by the employer it is work equipment; if work equipment is involved then the incident is work related, fault or no fault. If the IP is off for more than three days this needs to be reported,

I wasn't suggesting that PUWER only applies when there is a fault with the equipment. I was saying that the equipment wasn't at fault i.e. Didn't cause the injury so didn't really come into the equation. The only thing that needed to be looked at was if the injury needed to be reported.

I think I will change my profile name to my christian name as when people call me Farrell, I always feel that I have to be on the defensive and it was me who made it that way.

This is classed as an accident at work fact yes, fill oiut the accident form, if in hospital for more than 24hours or off sick for 3 days then report to RIDDOR, do an investigation,is the equipment fit for purpose, has it been PAT tested, job done.

This PAT must be a great tester if he/she can prevent people getting burnt when they take hot dishes out of an oven!

My 2 cents,

An accident? Yes
Work related? No

If I burnt my mouth, cut my thumb, but my lip whilst preparing or eating my diner at work using this equipment as intended I would not expect work to be responsable. Cooking knives are sharp to cut things, kettles are used to make water hot, microwaves are used to heat food, should it be any suprise that when using these everyday household kitched utensils when at work or home they are sharp, hot etc... No.
