If we hire a haulage firm to carry our work to our customers and return with a load. Who is resposible for the driver. On our site i know we would but once he left who is then responsible for him as we have entered in to a contract with the haulage owner.

I would say the haulage company. once he/she leaves your site you have no further control or contact with said driver. But I may be wrong

If you have contracted a haulage company their driver remains their employee.

The query is not concise enough. There are numerous laws and regulations to consider. Under road traffic laws and regulations, it could be the driver him/herself.

In principle it is the haulage company who are the also the employer. However, depending on circumstances it could be hirer pursuant to s3 HSWA. The driver is responsible for his/her actions on the road and for making basic checks of the road worthiness of the vehicle. Sometimes in law there can be a shared responsibility between one or more parties - it is not always so clear cut.
