question

I have an owner of a company who carries out groundworking activities and mainly has self employed  (subcontractors), carry out the works, what responsibility does the owner have to ensure that the subcontractors are qualified, suppling the PPE etc, or is this the responsibility of the subcontractors?

The owner must make sure that the subcontractors are competent in the work that they are employed to do and are doing so in a safe manner. Provision of PPE may well be a contractual thing but I would expect the subcontractor to come with all equipment, RAMS etc

Whilst there is h&s legislation which covers various duties, some of which is over-lapping, I would think the CDM Regs 2015 would be the most significant. I assume this company is the Principal Contractor for these groundworks, in which case regulation 13 would apply. If not the PC, then regulation 15 would apply.

As for PPE, it is usually for sub-contractors to provide their own, or in some cases the PC may provide it with or without a charge.
