Hello everyone,,

Not another should I report under RIDDOR, I promise!

Does anyone know if an injured party can get the RIDDOR report (if it was submitted) on their incident from HSE please?

It's not for me, I am asking for a family member, who had a very nasty fall at work, whilst in work, being paid, undertaking work duties, and within the premises they were employed, they were ferried by ambulance from their workplace to A&E and underwent emegency surgery for multiple compound, complex fractures in his leg.

He was hospitalised for 2-3 days, then in recovery for around 6 months before he could look for work, so I believe it should english news capread have been reported?

If people think it is possible to get this from HSE, could anyone please advise how?

I am guessing a GDPR request would do it, but I would expect an oficial way?

Thanks in advance for any help.

Do your family member a gigantic favour and tell them to seek professional legal advice if they want to pursue a claim for loss of earnings/pain & suffering.

You could try and get the RIDDOR (IF it was submitted) from the HSE but realistically what if anything would you hope to achieve with it compared to a claims firm used to dealing with such documentation day in and day out?

Even if you get the report from the HSE any claim is against the employers liability insurance so be prepared for no response from the employer whatsoever as they will pass all correspondence to their insurer.

GDPR is EU regulation - we have our own enactment under UK law

Go to a solicitor as R says they will obtain all the information for you all you have to do is the date and time and agree to access the treatment notes etc...the national accident helpline are one such conditional fee arrangement suppliers..

  Why does this person want the RIDDOR form?  If it is to bring a personal injury claim you need to advise them to see a good personal injury solicitor.  All accident reports including RIDDOR reports would be disclosable documents in the event of a claim.
