If a haulier falls out of the truck's cab on our premises and injures himself, potentially resulting in a RIDDOR, would we need to report it since it occurred on our premises, or would his employer?

In the first instance, it is the responsibility of the employer to make the RIDDOR report (assuming the injury resulted from the employee's work).

Share your information of the incident and remind them that as the employer it is their duty to report.

This scenario involves some nuanced considerations regarding workplace safety reporting in the UK. - Location: The incident occurred on your premises, which is a key factor.
- RIDDOR (Reporting of Injuries, Diseases and Dangerous Occurrences Regulations) requirements: These generally apply to the responsible person, which is usually the employer.
- Responsible party: In this case, there are two potential responsible parties - your company (premises owner) and the haulier's employer.
- Determining factor: The key consideration is who was in control of the premises where the accident occurred.
Based on these factors, it's likely that your company would need to report the incident under RIDDOR, as it occurred on your premises. You have a duty of care to individuals on your property, even if they're not your direct employees. However, the haulier's employer may also have reporting obligations, especially if the incident was related to their work activities or equipment. To ensure full compliance, I'd recommend: - Report the incident under RIDDOR as the premises owner.
- Inform the haulier's employer about the incident.
- Consult with a health and safety professional or legal advisor for specific guidance.
Does that help?
