I am a Transport Manager for a recruitment company that specialises in transporting staff to work in mini-buses.
As far as I am aware, it is a legal requirement to carry a fire extinguisher and first aid kit. Is this correct, if so where can I find the relevant documentation? I am currently in dispute with my MD.
I have spoken to Local Authority, Fire Authority, HSE and the DTI. The last 2 told me to speak to the other.
Can anyone help?

It depends upon the use to which the vehicle is being put, licenses, permits, wayleaves, etc under which it is being operated, etc. However, at the least, all the best gudance says 'Yes' and probably a foam type is now best in view of the situation with Halon and the confined space issue with CO2. The best people to speak to are the Community Transport Association (Bill Hyde) on 0161 366 6685 or 0161 351 1475. They have a number of leaflets on the use of minibuses - both their own and DETR's. Additionally RoSPA publish a 'Minibus Safety Code of Practice' (Tel 0121 248 2000).

The Community Transport Association, Highbank, Halton Street, Hyde, Cheshire SK14 2NY operates a Minibus Driver Awareness Scheme and also provides a Minibus Drivers Handbook ISBN 0 9522439 2. Page 76 of the handbook states 'By law minbuses are required to carry a fire extinguisher'. It also goes on to state that 2 are required when wheelcahir users are being transported. It may be worth contacting them on tel. 0161 351 1475 or 0161 366 6685 for further clarification.

Amendments relating to fire extinguishers
8.—(1) In regulation 35, for paragraph (1) there shall be substituted the following paragraph—
" (1) There shall be carried by every vehicle suitable and efficient apparatus for extinguishing fire which is of one or more of the types specified in Schedule 4." .
(2) For Schedule 4 there shall be substituted the following Schedule—
SCHEDULE 4
(See Regulation 35)
FIRE EXTINGUISHING APPARATUS
A fire extinguisher which complies in all respects with the specification for portable fire extinguishers issued by the British Standards Institution numbered BS 5423: 1977 or BS 5423: 1980 or BS 5423: 1987 and which—
"(a) has a minimum test rating of 8A or 21B, and
(b) contains water or foam or contains, and is marked to indicate that it contains, halon 1211 or halon 1301.
As someone as previously mentioned the bit with halon (remember that is 1989) foam may be the best option.
