Under Regulation 15 there is a requirement to provide emergency stop buttons/switches on work equipment. Does this also apply to such equipment as Abrasive Wheels etc, as i have been told that this type of workplace equipment is exempt from this requirement.

I would appreciate some guidance on this matter.

The Abrasive Wheels Regs 1970 were the main legislation for this equipment until PUWER came into force. These regulations no longer apply. PUWER 98 replaced in total a huge amount of workplace machinery legislation.

Regulation 15 of PUWER will apply and under the Interpretation of the regulations work equipment is identified as "Any machinery, appliance, apparatus, tool or installation for use at work".

Totally agree with Peter. PUWER 98 incorporated Abrasive Wheels, so everything applies.

It was PUWER 92--not PUWER 98 that replaced most of the Abrasive Wheels Regulations 1970--the exception being Regulation 9-Training and appointment of persons to mount abrasive wheels and the schedule --which was ultimtely replaced by PUWER 98 (Regulation 17 of Abrasive Wheels 1970 was replaced by The Workplace(Health, Safety & Welfare)Regulation 1992 .

Regulations 11 12 13 14 15 16 17 18 19 20 21 22 23 24, 27 and Schedule 2 of PUWER 92 did not come into force until 1 January 1997 for work equipment first provided for use before 1 January 1993 (the then "existing equipment") .The provisions of regulations 11 12 13 14 15 16 17 18 19 20 21 22 23 24 were generally specific 'hardware' provisions, ie they prescribe features that relate to the equipment itself--INCLUDING THE NEED FOR EMERGENCY STOPS

For those ocassions when abrasive wheels are used for woodworking, it is worth looking at the ACOP and Guidance L114, 'Safe Use of Woodworking Machinery' and WIS 38, 'PUWER 98: Retrofitting of braking to woodworking machines'. The ACOP says that braking devices should be fitted where the risk assessment shows that it is necessary but in listing types of machines where they are considered necessary does not refer to abrasive wheels.

Off the top of my head and without looking at the Regs. I seem to remember that the requirement to fit emergency stops does not apply where the sudden stopping of the machine would be a hazard in itself.

This may well be the case with abrasive wheels because they are inclined to shatter if exposed to sudden stresses.
