My question is, after reading the guidance on "Directors Responsibilities" does the Director responsible for safety have to be the MD? (as he normally signs the health & safety policy, thus accepting responsibility), or does the organisation have to nominate another Director to fulfill this role?

A 'nominated person' is responsible, this usually means that the MD has the opportunity to 'deligate'! In my experience this is often the HR Director or similar, often someone with little or no safety training etc.

As stated the Managing Director does not have to be the person responsible for Health and Safety , but as you wll know ,there is a collective responsibility on all Directors to ensure that the responsible person is also a competent person . It is also a responsibility that a lot, but not all, Directors pay little or no attention to until something happens .
I personally believe that any Director with the responsibility for Health & Safety should hold appropriate qualifications or have sufficient knowledge and experience of the subject , after all you do not have a finance Director without a financial background and this would be a perfect example of a point to argue your case .
