I have been asked to advise on H&S legislation for a small retail outlet. By small I mean a village shop/post office with two full time employees and one part time employee.
I have in my mind that this type of retail outlet is exempt from certain regulations/sections of HSWA but cannot now find these exclusions.
Does anyone know of any specfic exclusions or did I just dream it!!

Employers with fewer than 5 employees are exempt from HASAWA 2(3) (need for written safety policy); and requirements in MHSW Reg 3 to record significant findings of risk assessments (ditto COSHH) and in Reg 5 requirement to record 'arrangements'.

I suggest you get (and provide them with) a copy of INDG324 'Stating Your Business'. It gives more than the title and cover implies and includes a short, but useful, bibliography.

PLease note that they are exempt only from having the things mentioned in writing. THey are still required to have a safety policy and carry out risk assessments.
Have you tried the IOSH venture www.safestartup.org?
It is very good and easy to use for small businesses. You simply select the industry type (e.g. catering) and how many employees and it will point you in the right direction.
