Posted By Malcolm Earl At present I am employed by an airline engineering company in the UK. The company sends on regular basis engineers and others overseas for short periods of time. Whilst I have read up on the duty of care I am still not sure that I have got it right. Am I right, in that the company has a duty of care if the employment agreement was made under UK law and the act or omission would be actionable in UK. The only legislation that I can find that mentions being in an aircraft are the PPE Guidance PAGE 15. (This says UK space only). Are our employees covered under this legislation and other or not when working abroad?

Posted By Stuart Nagle Malcolm. The company owes its employees a duty of care if sending them overseas to work. At the country of origin is the UK, their responsibilities to you, provided you are a non-resident of the country visited and the company is not registered there but in the UK, is the UK legislation. This for instance also applies on UK soil in Uik government offices overseas (eg MOD Embassy's etc). Visits to overseas, just as visits to anywhere else to work, should be risk assessed. This of course, in respect of overseas work, may be more complicated than your run of the mill job, but should be done. The company should also (as a good employer) look to provide for your security and advise on matters and provide some form of advice/training for overseas travel - particularly for areas where security may be an issue.
