Please help! If a company has identified a piece of legislation as part of their maintained H&S register, and do then not comply with that piece of legislation what particular element of OHSAS 18001 do they not comply with with.

I do not have my copy of 18001 with me but if I remember rightly it is very similar to ISO14001. In 14001 it would be a non compliance with 4.2 (Policy) which requires a commitment to complying with legislation.
However, if you have a legal non compliance, a clause requirement in 18001 should be the least of your worries.

Paul, thanks for the prompt reply.
If the Company has a written policy detailing a commitment to comply with current legislation, does this mean that it is non-compliant to the standard if it is in fact not complying to a particular piece of legislation?

If the company has made a Policy commitment to comply with legislation and then it is found, upon audit, that there is a legal non compliance, then you would have a non compliance with your own system documentation. If you had no commitment to comply with legislation then you would have a non compliance with the clause in the standard.
Any which way, a legal non compliance should get you a major non compliance at audit.
