Posted By Kevin West During a Health and Safety Training Course a delegate mentioned compensation claims being successful in the U.S for the stress caused from the fear of contracting an Asbestos related disease (following a history of working with Asbestos). These claims are successful even though there are no signs of any disease. I am wondering whether anyone else has heard of such tales and more importantly what are your thoughts on the ramifications this will have in the U.K and whether this type of claim will spread to other diseases such as those caused by work in mines (silicosis, emphysema etc. A hot topic in my part of the world. Posted By Martin Daly I am aware of a case in Ireland where a caretaker working in the Irish Parliment buildings took a case and won because he found out that there had been asbestos around the pipes. There was no proof that he had been exposed to the asbestos or was going to suffer any harm. He won his case because the court decided he had been exposed to risk by his employer. This case has been of concern to those empolyers that expose their workers to smoking in the work place ie pubs in particular. yurs Martin

Posted By Kevin West Interseting. On that note. In Ireland moves are a foot to ban smoking in all pubs, restaurants and workplaces. (Irish)Health Minister Micheal Martin is expected to announce the news later today (30.01.03)at the launch of a report highlighting the effects of passive smoking in the workplace.
