Posted By Jonny I have been asked to look into the case of partial deafness in a retired road construction worker. The man is 72 years old and has been retired 9 years since 1994. He now has to wear a hearing aid ( been wearing one for approx 7 years) Does he have a claim for industrial injuries compensation, and if he does what should be his first course of action. He worked in the industry for over 40 years for sub-contractors and never wore hearing protection. Thank You, Jonny.

Posted By Neil Pearson He needs to try to identify at what stages in his career he suffered the hearing loss. He will have to show that he suffered hearing loss, and that this loss resulted from employers/people breaching their duty of care.
So he needs to identify specific companies or people that are responsible for the loss, and collect evidence of the loss and the negligence of the people responsible. May not be easy, especially if he had lots of employers and varied work.

I suspected that it will be a difficult case to prove, especially working for different sub contractors over 40 years. I will send him to have his hearing assessed, as they will be able to determine if his hearing loss is age related or due to noise damage.
