Can someone guide me to the legislation regarding fall protection ie when and under what circumstances must fall protection become mandatory. I know all about it being risk baased and conducting a risk assessment but wondered if there was any actual legislation with figures ???

Check the HSE website.
The Health and Safety Commission have included 'Falls from Height' in their eight Priority Programmes chosen to meet the targets for the reduction in injury rates in the workplace. The web page provides links to guidance, research and other useful resources.
One thing that often falls to the wayside: Fall protection can take many forms but if using lanyards and inertia reels. Don't stop your risk assessment at the point where a person may have had their fall arrested by any harness based PPE. Trauma from these situations can lead to organ failure and death within minutes so always include a "rescue plan" to get people into a safe condition ASAP. This can include training your own staff or ensuring someone will know to call 999.

For legislation, starting point should be Construction (Health, Safety and Welfare) Regs 1996, especially regs 6,7,& 8. Supported by HSG 150 - Health and Safety in Construction.
Also try looking in Workplace Regs 1992 and PPE Regs 1992.
