Under the reporting of accidents under RIDDOR, if an accident happened on the Tuesday and the employee was off work from the Wednesday and reports back to work on the following Monday is it still reportable under the ‘more than 3 day injuries’ because the employee never works on the weekend?

It depends on when the injured person is fit to return to work whenther or not that day is a working day.

Posted By Anthony Slinger of course, when asked employees sometimes say they were unfit over the weekend (poss trying to make you feel guilty?)which affects reporting. A firm I know of has a high 3 day reporting record because of their shift pattern and staff claiming to be unfit during the time off between shifts. I know this seems cynical and there are genuine cases.

Posted By Peter Rees I agree with Peters comments - para 56 and 57 of the RIDDOR ACOP explain this in plain English (for a change!).
There is also an interpretation by some HSE Inspectors that this time off also includes holidays that were to be taken, and not just weekends!

Posted By Simon Ayee For the scenario given reportability depends on fitness for work on the Saturday (as Paul and Jack have said). This should be established by asking the employee. If they say they were not fit for work (!) then it is reportable.
If an abscence of one, two or three days due to an injury is immediately followed by leave that could take the abscence over three days then if unfit for the employee should to inform employer. As some employees may not volunteer this information then as above they should be asked and the answer recorded.
If in doubt you could report it anyway or discuss it with the ICC or your Inspector.
