any help on this one ,gritter driver told to work from 07.30-22.00 monday to wedensday,2 half hour breaks ,no tacho ,driver fills in a log book.what rules cover this or are there none.

Hi Ian,

Drivers hours are governed by EC directive 3820/85 with one or two European Court of Justice rulings having to be taken into account as well. However I am pretty certain that gritters are classified as "Highway Maintenance & Control Vehicles" and as such will be exempt the EC Drivers' Hours rules.

Not sure how a tribunal would view the case as it could be argued it was foreseeable and more drivers should have been available.

I can not answer your question specifically but on normal driving hours a maximum working day of 15 hours with a maximum of 10 hours driving with a minimum of 2*45 minute breaks.
It is the police who are the enforcing authority so they should be able to advise you

In case you're unaware, the TUC has recently set up a website for unionreps which you could subscribe to which would probably help you in your query.
