Posted By Joe Ridley Hi there,
I would like to ask if an accident is reportable under RIDDOR if it is reported the next day, particularly where a member of the public is involved and taken to hospital but did not report it at the time.
Cheers

According to Reg 3, if the injured person was taken from the site of the accident to hospital, the responsible person must report the injury. The assumption would probably be that the injury is reported immediately but, if you only found out about the incident on the following day, then that is the time to report it.

Posted By Steve Sedgwick Joe If the injury is a "major injury" then report asap
If the injury results in the person not being able to to do their normal work for more days then report within 10 days
As for reporting all injuries requiring someone to go to hospital I beleive that this is incorrect.
Anyone kept in hospital for more than 24 hours following a works related injury is classed as a "major injury" under RIDDOR.

Posted By Adrian Watson Dear All,
Regulation 3.—(1) of The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 states:
"... where— (c) any person not at work suffers an injury as a result of an accident arising out of or in connection with work and that person is taken from the site of the accident to a hospital for treatment in respect of that injury;
(d) any person not at work suffers a major injury as a result of an accident arising out of or in connection with work at a hospital; ..., the responsible person shall—
(i) forthwith notify the relevant enforcing authority thereof by the quickest practicable means; and
(ii) within 10 days send a report thereof to the relevant enforcing authority on a form approved for the purposes of this sub-paragraph, unless within that period he makes a report thereof to the Executive by some other means so approved."
Therefore to make it reportable by you, the person must have been injured at your workplace and have been taken directly to hospital. If both conditions apply you must report it.
Regards Adrian Watson.
