Hi,
I hope someone will be able to throw some light on to this particular subject! One of the surgeries that I advise needs some guidance on who is liable if the self employed window cleaner that they employ has an accident on their premises. The window cleaner has stated that he has insurance and is o.k. I am concerned about the providing safe access for window cleaning by the building duty holder. How far do you go with this one? Any thoughts will be appreciated.

the duty of protection of the window cleaner may fall upon either of the following: the window cleaning organisation or the building owner/occupier. occupiers may need to provide safe anchorage points for harnesses etc. the least that the occupier should do is insist on a risk assesment and permission to work form.

My rule of thumb is that if it happens on our premises, we probably have responsibility.

This is not correct in 100% of cases of course, but it is better to start from this permise, and work your way out!
