Posted By Murray S Graham We have recently put our cleaning contract out to tender, and have invited prospective companies to come and have a look around our premises. One such company representative had some reservation about cleaning our smoking room, stating that some new legislation was due out with regards to passive smoking. I haven't seen anything publishing the arrival of any such legislation. Can anyone help or point me in the right direction. As always, your help is very much appreciated. Aye Murray

Posted By Gavin The only thing that I can think of is the general discussions around banning smoking from public places / work / restaurents / pubs, etc. I have not seen any specific proposals by the HSE, but rather guidance INDG63 on passive smoking. There is also specific legislation in regards to smoking in rest areas or rest rooms which falls under Regulation 25 of the Workplace (Health, Safety and Welfare) Regulations 1992. This states that: 'Rest areas and rest rooms should be arranged to enable employees to use them without experiencing discomfort from tobacco smoke'. The HSE produced a consultative document in 1999 CD151, but nothing seems to have happened since.
