Posted By Lorraine Mitchell With reference to the court case and B & Q being fined £550,00 after crushing a woman the death under an FLT in one of their stores. They were fined because they were using an FLT in one of their stores with out a look out (as reported in Daily Mai; Wed 28th July) It was also reported that they had been warned six times in the past 18 months leading up to this about drivers working alone. Has the aproved code of practice changed and do you have to have a banksman / look out for all reversing operations with FLT'? I need to know as I will need to change my training for FLT operators. Please advise.

Posted By Pat Burns MIOSH - SpDipEM - AMIQA They were fined for breaching health and safety legislation which led to the death of a visitor to their store. As I recall they breached their own health and safety policy which stated that a banksperson (I am not sexist)should be used for operations within the store. This would have been identified as a control measure during risk assessment as a result of findings such as restricted aisles, visitors within the store including elderly and young persons etc. What you need to do is review your own assessment for FLTs on your own premises and ensure that risks of injury are reduced to as low as reasonably practicable.
