Posted By Tony Clark Can anyone out there help me I am trying to study case law and in particular the case of Basingstoke and Deane Council versus Sainsbury's whereby they were found guilt of breaches of HASWA sec 2 etc.
I am trying to get the full story and am having difficulty. Does anyone know the case and the facts please.

As I recall, Sainsbury's pleaded guilty, hence technically the case is not case law, ie a decision which other courts must take heed of.
Basically, the case was about recognising that the level of competence required of a "competent person" must reflect the needs of the employer, ie be risk based. Horses for courses.
