Liability for Placements - EL required or not?

Hello all,
I have a query about a sole trader working (from home) as a H&S consultant.
They don't have any employers liability insurance as they don't have any employees. However, what would their liability be if:
1) An associate consultant came with them to look at a job and something happened to the associate consultant?
2) A NEBOSH student had asked the consultant if they could shadow the consultant for a day, or even a week, to give them an idea of the kind of work that they did and something happened to the student?
I'm assuming that no EL would be required in the case of an associate consultant, as they are not an employee. However, what about someone who has come along with you for a nosey on a job to gain experience/insight? Would EL be needed for them? Or, would it be assumed that the PL of the client would cover this person as a visitor on their premises?
Regards,
Karen

Karen,
An interesting question. You are quite right that the consultant (being a sole trader) would not need EL cover. However I would hope that he or she has Professional Indemnity cover and quite often this comes with a Public Liability extension so the associate or student may be covered under this policy extension (best to check though). In addition, the Public Liability cover of the client who had granted permission for the consultant and the associate/student to come onto their premises should cover them for any injury or loss incurred.
As with anything to do with insurance this should always be checked out with the relevant parties as 'Get Out' clauses are often inserted.
