We have a substance coming to site which is both Toxic and an oxidizer. Both of these have the same COMAH thresholds. Which category should I put the quantity of the substance in?
Any ideas?

It will probably depend on whether classifying as one or the other will cause the site to become upper tier as opposed to lower tier due to application of the aggregation rules.
The measures you will need to take to control the risks will be the same in either case as you will have to consider both the toxic and oxidising properties of the substance.

I have had this problem before, the approach I took was to account for the quantites in each catagory, we are top tier anyway. If you don't want to do that I would identify which is the primary classification for the substance and classify it in that catagory.

Maybe you also need to consider looking at other chemicals on site and the reactivity with them. If there are chemicals that will react violently with the oxidiser then that would be the primary hazard compared with the toxicity or visa versa. As with any chemical exposure if there is no exposure then there is little hazard or risk, your HA must also take into account leakage or accidental release.
