I've been delving through the Working Time Regs on a night work issue but have come up blank. Night work is limited to 8 hours (averaged over a 17 week period) but can workers voluntarily exceed this as they can with the 48 hour working week limit providing its in writing or is the night work 8 hour limit a strict one?

My understanding is that an opt out is an opt out, no matter which bit of the regs. I'm only 80% sure tho...

Is that true? Would be a handy answer if it is. I was under the impression there are some parts of the Working Time Regs which are absolute and some which employees can choose to opt out of. For example, I didn't think adolescents could opt out of their night work rules? (I could be wrong, it wouldn't be the first time - I'm big and ugly enough to admit it!)

According to the DTi document "Your guide to the working time regulations" a night worker cannot opt out of the rules relating to night work.

The opt-out only applies to the averaged 48 hour working week.
