Our company had a lady who fell on Xmas Eve causing her to have a bloody nose. She did a self cert until the 28th which makes this accident reportable. My view is that Xmas day and boxing day are holidays so should this accident be reportable, Yes RIDDOR is clear in that anything over thee days is reportable but nothing is mentioned about National holidays i.e Xmas day views please?

When you say "self-cert until the 28th" do you mean she returned to work (or was fit to do so) on the 28th? If so it's not reportable as it's more than three days not including the day of the accident and this would only be three days.

If a person is injured as a result of an accident and is unfit for work for more than three days, regardless of whether any of those days were weekends, national holidays or days when that person would not normally have been expected to work, then the accident is reportable.
The test to be applied in your particular instance is this;
If the accident had occurred on a normal Friday, (i.e. not before a Bank Holiday), would the injured person have been back in work on the Monday? If not, it is reportable.

HSE guidance says "When calculating 'more than three consecutive days' the day of the accident should not be counted, only the period after it. Any days the injured person
would not normally have been expected to work, such as weekends, rest days
or holidays, must be included."
So the answer depends on when your person was fit to return to work.
28th Dec - not reportable as only three days
29th Dec or after - reportable.
