I have been asked a question regarding an asbestos decontamination and encapsulation project. Would the stand alone works being carried out fall within the scope of construction work relating to CDM. The works will satify all other criteria i.e over 30 days and number of men on site.

In my opinion the works would be covered by the CDM regulations as I believe that they would be considered as either, renovation, repair, upkeep or maintenance, which fall within the definition of "construction work" part of which is set out below.
"construction work" means the carrying out of any building, civil engineering or engineering construction work and includes any of the following—
(a) the construction, alteration, conversion, fitting out, commissioning, renovation, repair, upkeep, redecoration or other maintenance, de-commissioning, demolition or dismantling of a structure.
In any event the nature of the works is likely to require a licenced contractor who in turn would have to notify the HSE of the project and ensure compliance with the Asbestos at Work Regulations.
In both cases the HSE are notified and the work should be planned and carried out safely so why not seek the opinion of the local HSE office.

I would tend to agree with Martyn that the works will inevitably fall within the definition of ‘construction’ work given in the CDM ACOP. If the HSE are the enforcing authority and the work will require five or more persons to be on site, then the CDM Regulations will apply.
In this case, if the construction phase lasts longer than 30 days or involves more than 500 person days, the Planning Supervisor for the project must ensure that the project is notified to the HSE as soon as possible after his/her appointment, using Form F10.
The Licensed Asbestos Contractor will be required to notify the HSE of the proposed work on Form ASB/5 at least 14 days in advance of the start of the project. This requirement applies regardless of whether or not the work is subject to the CDM Regulations.
