Has the HSE ever issued clarification or guidance since the 1999 act as to the term 'competent person'?
In particular, does this term imply that the competent person requires some sort of formal qualification (and at what level), or is experience alone enough?

I dont anything produced by the HSE, however RoSPA use the pnumonic SKATE to difine a competent person, where:
S= Skilled in the task to be undertaken.
K= Knowledge of the task and of relevant rules and regulations applicable to that task.
A= Attitude, as in following the rules and carrying out the task as safely as possible.
T= Trained in all aspects of carring out the task safely.
E= Experience. Not just in carrying out the task but its implication on other areas.
If the person can fullfill the above criteria then they can be classed as competent.
