Posted By tony burton In order for an accident to be reported in the accident book, when does it have to be reported by the individual. For example, I had one of my employees allege that he had an accident on a Wednesday but didn't report it until the Friday. On the day of the alleged incident, the individual continued with his normal tasks without informing anyone, he then worked his normal shift on the Thursday, again not mentioning it to anyone. On the Friday he phones in to his workplace saying he felt stiffness in his shoulder, probably from an incident that he had on the Wednesday to which there were no witnesses. He did not go to a doctor, but self-certificated. Do I have to accept that an accident occured and put it in the accident book or is there anything else that I can do

Posted By Paul Craythorne Tony, Does your company have clear and concise accident reporting procedures? If so, have these procedures been formally communicated to your workforce and, in particular, the person who had the accident on this occasion? If the person concerned is fully aware of the procedure I suggest that, as part of your accident investigation process, you determine why, on this occasion, he chose not to report the accident at the time. If it transpires that he was fully aware of the procedure and If failure to report an accident within a reasonable timescale is a disciplinary offence (and I would suggest that 2 days is unreasonable) then you are quite within your rights to invoke the disciplinary procedure. Make sure that you do a thorough investigation along the lines suggested in HSG245 and record the fact that there were no witnesses as they are sure to appear if and when an insurance claim is made. Posted By Pete Walker Paul, I agree with earlier comments and would also add - the DWP issued a new BI 510 accident report book in 2003 and inside it clearly states that the injured person must report the accident as soon as they are able. You must make this clear to all your employees that they have to do this, otherwise you could have grounds to refuse to include the accident in the book. Before anyone adds how do they do this when "out cold" - the full details are in the book.

Posted By Stephen Boardman Morning Tony, You didnt say how long this individual was off work, If he self certified on the Friday and did not return to work before Tuesday morning on the following week, you will also need to report under RIDDOR. agree with previous 2 days is to long to report an accident especially if you have procedures in place, but as you said yourself I am afraid you will have to accept that this is a workplace accident and investigate accordingly.
