Posted By Peter Younger Opinion please? I have 17 Area Managers, who work in the field, driving between retail stores over a working week. They do not spend all of their time driving, but an average working week can be around 48-50 hours. Does this new legislation apply, in this example?

Posted By Graham Frobisher Peter, the Road Transport (Working Time) regs apply to vehicles fitted with a tachograph and thus your area managers are not affected. However, the Working Time Regulations do apply and as such if the employee is likely to exceed an average of over 48 hours in a 17 week period, the employee should sign an 'opt out' declaration. Posted By TBC I don't think anyone 'should' sign an opt out clause. Obviously these people and many others are very busy driving around visiting and talking the handsfree on a regular basis. Time management should be a first priority and failing a reduction in hours - make them sign an opt out clause.
