This is a personnel request from me. MY wife is currently on maternity leave. While she has been off, the company who she works for have given her job away. When she goes back there will be no jobs available to her at the current management level she now works at. She would have to have to take a position at a lower level with less pay. Not where she wants to work. She was already only working part time due to family, and will be going back part time. Can her company do this. What are her options

I believe that under the employment Rights Act 2002 and supporting Regulations on Maternity leave, if your wife returns to work within 26 weeks of the date maternity leave started, she is entitled to her old job back. However, if she takes the maximum 52 weeks maternity she would, when possible get her old job back but failing that, any reasonable alternative with the same terms, conditions, status and salary.

I recommend you contact the Maternity Alliance, they have a website and an advice line. They exist to advise on exactly the sort of problem your wife has. Sorry to hear this has happened to her, good luck in sorting it out.
