Posted By BarryS A colleague works in the care sector and is experiencing difficulty in getting staff to ask for SOPs / Risk Assessments / Insurance details from window cleaners, repair men etc who call out to clients houses to perform small maintnence tasks - he is being accused of being very pedantic with the cry 'If they have public liability insurance what does it matter' being thrown at him - do you guys think he is being pedantic or smart asking the lcoal window cleaner for a Risk Assessment / SOP?

He should ask the doubting thomases who will pay when one of these uninsured contractors causes a problem. Once they realise that the resulting claim will come out of their budget, the DTs may suddenly decide that your colleague is talking sense. Paul

Posted By Ron Hunter I can't see what business it is of the Care Worker where these are arrangements between the client (householder) and the tradesman? If the LA Social Care Division is engaging these contractors on behalf of vulnerable/special needs clients, then there is a duty of care issue - then all these issues could be managed at the 'front end' by contractors satisfying arrangments for addition to approved lists. The LA Procurement, Housing or Property Management division should be able to assist?

Posted By Stuart Nagle I dont believe that the legal requirements to undertake risk assessments in the workplace excuse anyone.....!! They include employers and self employed persons. Is there another category of person working for the care industry we are not aware of.... I don't think so..... So the requirement is clear and unambiguous. Risk assessment, risk eliminated or control measures in place to reduce risk to minimum, PPE and other equipment to guard against residual risks that cannot be eliminated and work carried out within a safe system of work.... Nothing pedantic about legal compliance so far as I can see.... Stuart...
