I am having a row with someone who claims that in the Workplace Regs a workplace dating from before a set date doesn't have to comply with the safe Traffic Management part. Confirmation of who is right please/ the date....

"doesn't have to comply" is taking it too far but I can see where they get it from.
Reg 17 which relates to workplace tfc says that for workplaces in existence before 1/1/93 (which are not modifications, extensions or conversions) they only have to comply with Reg 17(2) - which is about the actual number, width, size, etc of roadways so far as is reasonably practicable. This "exemption" does NOT apply to Reg 17(1) which says that the workplace must be organised to allow safe circulation of pedestrians and vehicles.
The guidance specifically mentions the following issues in relation to this "exemption"
1. Obstructions into roadways may be allowed provided they are clearly marked.
2. Roadways may not be of sufficient width, but passing places and a traffic management system should be introduced.
3. Separation of vehicles and pedestrians may not be sufficient, but passing places and a management system should again be introduced.
All in all I would say you were more correct than your colleague!
