Does anyone know if it is an absoulute requirement to prvide a means of heating food in the workplace. I know it is a requiremtn under the regs but has anyone any experience of not compying with this. I mean to say if your staff dont need a microwave oven and they have all agreed that they dont need one, do u still have to get one??? daft i know.

The requirement under the Regs themselves is only to provide suitable facilities for eating. The bit that refers to facilities for heating food is in the ACoP, where it says "Eating facilities should include a facility for preparing or obtaining a hot
drink, such as an electric kettle, a vending machine or a canteen. Workers who
work during hours or at places where hot food cannot be obtained in, or
reasonably near to, the workplace should be provided with the means for
heating their own food."

So you do not have to do it if they can get hot food elsewhere nearby. If they cannot do this, then I would suggest that if it really is the case that no-one in the workplace wants a microwave that you get this in writing and do not provide one. After all although ACoPs have special status, they are not law and I would think it would be an acceptable defence to prove that none of your staff wanted - or would use - a facility for heating food.

please remember that a microwave, kettle and oher similar items require PAT testing.
in my experience, because these items are provided by the company staff tend to take less care compared with their own property so someone should be tasked with checking they are clean and not showing signs of wear around the plug(s)

Hi Rich

Just a thought, if you are to supply microwave ovens in the workplace, I belive that the opertaion of the oven could affect persons wearing "heart pacemakers"!.

Always something to spoil the fun eh!
