Posted By Fornhelper I have just been informed (second hand info) that a company we deal with claim that they have been granted an exemption from inspecting a specific piece of lifting equipment. I am dubious about this claim (possibly it may be they have submitted an appropriate examination scheme but will check it out anyway) however it got me wondering.......do the HSE have the authority to grant exemptions from Health and Safety legislation to persons / companies / industries other than those specifically identified within the legislation? Steve

Posted By steven bentham Sometimes. In the older style Acts, you will find that excemptions can be given in certain circumstances. [If you have very prescriptive safety legislation it might not cover what you wanted to achieve, it might compromise safety or be uneconomic to the level of risk] If your people think they have this ask for the letter from the HSE or Factory Inspectors!

Posted By Paul Leadbetter Some legislation, COSHH, for example, allows for exemption certificates to be issued by HSE. In this case, the certificates can be for anyone or, specifically, for the MoD in times of national emergency. For lifting equipment, the only exemptions permitted are for the MoD in times of national emergency so the claim you have got wind of sounds a bit fishy to me. Paul
