As a college we place students with companies. We inspect the workplace and carry out a health and safety check. In some instances however the student becomes an actual employee of the company, after an introduction through the college, and attends college on day release etc. In these cases, provided we get a written agreement from the company that it accepts full responsibility for all health & safety matters, do we need to carry out any inspection/checks at all - or -do we still have some duty of care?

The level of responsibility would depend in part on the funding arrangement of the learners day release course. If the learner is funded by the LSC via FE or WBL then the training provider / college has a level of responsibility under your funding agreement. Point of info: http://www.safelearner.info/

As Roger has stated, it all depends on what funding arrangement is in place for the student and the type of course the student is undertaking e.g. Further Modern Apprentiship etc. The type of training would also determine the level of student reviews you undertake. These reviews should include a section on Health and Safety.
HSE Website: THE HEALTH AND SAFETY (TRAINING FOR EMPLOYMENT) REGULATIONS 1990. Paragraphs 1-10, this will give you some relevant information.
I work part time for a College and visit students in the workplace, so if you wish to email me, we can discuss further.
Lastly, you should never rely on disclaimers as a means of disolving responsibility!!
Hope this helps.
