If you undertake work on a bogie, but do not put this back on the train, is this maintenance classed as "Safety Critical" under Reg 2(1) of the above Regs ?

A good starting point would be to look at Appendix E (2) of Railway Group Standard GO/RT 3260 Competence Management for Safety Critical Work.

Thanks, Appendix E does specify Bogies, however I am getting a message that this standard has been withdrawn. If this is the case do you know if it has been replace by anything ?

As for safety critical work regs, check if rolling stock depots or sidings are covered as from memory I do not think that the 94 regs cover what you are asking. From memory the only safety critical staff in a depot are the fleet manager and the manager responsible for offering the trains as fit for service
