Posted By David Sinclair I am looking for an expert who might be able to assist with a planning application for premises near a Hazardous Installation, which falls within the COMAH Regulations. Can anybody help/recommend such an expert? Thanks. David

Posted By Frank Hallett Good morning David Could you be a little more informative please? The type of "expert" that you need, the type and function of the proposed building, whether it's in any connected with the COMAH site, etc will all have a bearing on the qualities and competencies required. I know that I am competent in many aspects of h&s but wouldn't put myself forward for a job without a lot more info. Of course, if you think that I might be of assistance, you have my email! Posted By Rob T David, I work on a COMAH site - what seems to be the problem with building or planning near the site you have in mind. Are you building another hazardous installation which may increase the risk to present installation? Please do e-mail me if you think I may be able to help. Cheers Rob

Posted By IanD Hi David First check with your council, if the land on which you are hoping to develop falls within the consequence zone of a Top Tier COMAH site, there are some pretty severe restrictions on what that land can be used for (Town and County Planning (COMAH) Regulations 2000) I think… This limits the scope of the development to low rise developments; car parks, single storey shops etc i.e. low occupancy. Any application made for developments within this zone gets sent to the HSE for their comments and recommendations (although this is only advice, the final decision rest with the planners). To summarise 1.Check if the site is top tier or lower tier 2. Check if the land is within the consequence zone 3.Speak with the planners and HSE before employing consultants. Regards Ian
