Posted By MC Good Morning All and especially any budding lawyers! If an employer provides certain welfare arrangements, such as a fridge and air conditioning, upon request (moaning!) for only a fixed group of employees and not all employees - is the employer discriminating? Can they be open to a discrimination claim? I await a deluge of replies and educated opinions with breathless anticipation! Cheerio MC

Posted By Cr8r Unless there is a sound reason why only these few have been given air con and a fridge. If the air con is there because of the work in that area only then fine. If they are given these things because they shouted loudest, then surely everyone will be shouting now and boss will crumble?! As for the fridge, I've known of fridges being installed when a worker was on medication that had to be kept in a fridge. Can't think of any other reason why someone would or should receive special treatment.

Posted By Robert K Lewis As it is a Friday the real reason for fridges is because we are worth it. Also it stops the milk going off and we can store our lunch in it to keep it fresh! Oh and yes my employer does supply milk, full and skimmed, coffee, full caff and decaf, squashes, orange and lemon. On most construction sites now fridge provision is not unusual so I cannot see why they are not normal in office premises. Bob

Posted By MC hi, yes it is basically down to the fact that this group based in an office environment and doing no hard physical tasks moaned the loudest (or they have special voodoo magic abilities, or it's the only chance the management have to get close to a person of the opposite sex! so many connotations!). operators on the factory floor havent been provided an ac where of course they are carrying out more strenuous activities and have been requesting something to deal with the stifling conditions alot longer.

Posted By MC Good morning Bob, Yes it is Friday - and I am going to have a ferroro roche as I am worth it! Yes fridge for all is great - good welfare practice - but this one is stuck in a clique group's room and most people arent even aware it's there! i think it's time for revolution!

Posted By Mark Talbot The workplace is full of such discrimination... bosses with leather chairs, PA's with drinks cabinets, directors with company cars, etc., Unfortunately, such luxuries always seem to be withdrawn about 6 months before I become entitled [argh!] I think fridges tend to lead to so much angst over food theives and rotting foodstuffs that people without them are probably better off. I still want my own office though, if anyone knows of an easy, high paying, high comfort job ....

Posted By MC Hola Mark, So true - life is full of inequalities. I am leaving my unfair workplace before my office becomes open plan! Open Plan, yes of course it fosters better employee relationships! Two options for you - get your own office or a manager of similar thinking as yourself so both of you can snooze (not together of course) as you wish!

Posted By MC Good morning Robert, Continuing this thread for eternity is my ultimate plan! and the fact that I am being a total time waster today. Seriously though, it is a real welfare issue because: - although there is no high temperature limit for the workplace, anything above 25 C should be dealt with by remedial measures (good practice) - in this case an ac unit has been provided for just a specific group of people not more than 5 in a specific room. People on the shopfloor who are doing a lot more strenuous work and bearing the same temperatures have not been provided with this remedial measure. - it is also a stress issue when people who have been asking for such a unit see newcomers get priority treatment - also demoralises employees and devalues them. Ok serious mode over - back to sleep

Posted By J Knight Yes, it's Friday and I'm looking forward to a weekend in a field in the Dales, wish it would brighten up though apparently summer comes back on Sunday. Discrimination is only forbidden on the grounds of race (inc religion), sex (inc marital status) and disability. Employers do discriminate in lots of other ways; I for example have my own office (it's mine I tell you. all mine! Bwuhahahaha!) but the Chief Exec has a PA AND a private office. So giving one lot a fridge won't actually break any laws unless it somehow conflicts with one of the above; and there is no human right to chilled fizzy drinks, John

I live in Sheffield and I recall one Saturday last year going for a walk in the Peak; the quietest part of the day was walking to our house from the bus stop, and we live fairly close to the city centre. My partner's parents live in Litton and its standing room only on weekends, John
