In the extract below From L24 Welfare Regs ACOP it talks about "refillable Containers" Do people think this applies to the various chilled water at work systems that are delivered such as Water at Work etc and if so how could you manage this. Additionally if it does not apply can someone explain why??
"Drinking water should normally be obtained from a public or private water
supply by means of a tap on a pipe connected directly to the water main. Alternatively, drinking water may be derived from a tap on a pipe connected directly to a storage cistern which complies with the requirements of the Water Bye-laws. In particular, any cistern, tank or vessel used as a supply should be well covered, kept clean and tested and disinfected as necessary. Water should only be provided in refillable containers where it cannot be obtained directly from a mains supply. Such containers should be suitably enclosed to prevent contamination and should be refilled at least daily."

Interesting point. First of all, the bottles supplied are covered, even sealed, until they are used, and therefore would meet that provision of the ACOP. They are single use and thus dopn't have to be cleaned. As to the rest of the ACOP; well, times have changed, and when the ACOP was written the idea of providing ready chilled mineral water at work was somebody's pipe dream (excuse pun). However, the fact that technology makes a provision obsolete doesn't mean that the law can be ignored. The question is, 'what is the purpose of the Regulation?' The purpose is to provide wholesome, fresh drinking water on demand. The ACOP explains, authoritatively, how this can be achieved; however, you do not have to follow an ACOP provided you can demonstrate that you meet the requirements of the law in another way. Bottled chilled drinking water meets the requirements of the Regulation (is actually better than tap water 'cos its cold) so you don't have to adhere rigidly to the ACOP,

John is right, the ACOP is not law per se, just a minimum requirement which, if you follow, will be accepted as complying with the law.
Buying bottled water from a reputable source, having the dispensers cleaned and disinfected as per supplier's recommendations will probably exceed the needs. I have not heard of any authority requiring you to change water bottles daily - this is clearly aimed at jugs / jerry cans of water.

The HSE Free publication, downloadable from the Internet, "Workplace Health Safety & Welfare, a Short Guide for Managers" clarifies the interpretation of this very point.
It states "The containers should be refilled daily - unless they are chilled water dispensers where the containers are returned to the supplier for refilling"
Nuff said?
