Posted By Julie Stone Do any others have to get construction workers through the CSCS maze? We have situation where we pay for our subbies to get trained (we can claim some money back on certain courses) if they leave soon after training can we charge them for the cost of training? I would be greatful to hear from others who manage CITB stuff

Posted By Robert. One company I know of requests return of the CSCS card to the company before the subbies leave (or they don't get paid). I believe that replacement cards incur a cost and the subbies would inevitably foot the bill for that. Also they may not be able to be employed without a card. So its a no-win for the company and the subbie, but a win-win for the CSCS(financially) Difficult call.

Posted By Frank Hallett Hi Julie As the subbies are not direct employees of your undertaking, you can impose any contractual terms that you wish with regard to re-payment, retention of CSCS cards and any other matter relating to the provision and accreditation of training for your companies' benefit to 3rd parties [the subbies]. I'm not entirely clear as the taxable benfit position of the subbies if you provide the training etc without retaining overall control, but I suspect that it could be considerable from recent personal discussions in regard to self-employed and training. Posted By Robert K Lewis You can impose contract conditions on the employer but not the employee directly in the subcontract situation. Certificates of training achievement belong to the person achieving the award, no matter who pays. If people wish to move on then that is always the nature of subcontractors. The relationship with any subcontractor exists for the duration of the contract so I think trying to recover money from the subcontractor employee is going to be difficult - you can recover from the employer. Posted By KB How about a radical solution. Do we not have to ensure that when we employ a person / company that they are competent to carry out their tasks? e.g. instruction,training, knoweldge. What better way to ensure this than contractually ensure that personnel either individuals or employees of a company have a current CSCS, CISRS, CPCS card. Although there are still a few exemptions the majority of trades are covered by the CITB. If there is a cost issue why not try and liaise with local authorities. In a lot o the cities there is a government initiative and lots of funding available for this type os training. This is in addition to costs that can be refunded by the CITB.
