Posted By STEVE Wondering if anyone has experience of this scenario? Young man on a goverment apprenticeship to become a tradesman, he has to study away from home 3-5hr journey (train) Allowed home each week-end (train ticket) paid for, but has to be back for Mon morning 08.00hrs, this means travelling day earlier(Sun) night When young man(19yrs)gets of train on Sun 21.00-22.00hrs dependant on train running on time there is no public transport to get to lodgings approx 1hr away. Persons whom run lodgings prepared to pick young man up if not to late, otherwise young man left to his own means in unfamiliar City, can get taxi but cannot recouperate his fare (£20)this comes from his small wage £70+. Does anyone owe him a duty of care to ensure his safety whilst travelling at night to get back for Mon start, or is the duty only whilst on premises Steve

Posted By Linda Crossland-Clarke Hi A funded apprenticeship scheme? Who funds it the LSC..? Do you have contact with a training provider who is responsible for the persons ultimate qualification? Who pays the travel and B&B fees? If this is via the fund, then there is usually a learning contract so, who ever has paid for the above will have signed some contract of responsibility and therefore hold a duty of care for the apprentice. However, under HAWSA the placement provider will also have obligations to ensure the safety of the apprentice on travelling to work.. I hand it over to someone else now...! Regards. Linda.

Posted By joe black His fares should be covered and if the only option is a taxi, then this will be covered. His Training Provider's Health and Safety Manager needs to risk assess this to be compliant with the LSC, and demonstrate that this is the only safe option under the LSC Safe Learner Concept.

Posted By Vicky Pye Hi Steve I am a H & S Advisor for the LSC so if you would like to contact me direct my email address is vicky.pye@lsc.gov.uk. One of the first things I would question is why the learner has been placed in a learning environment 3-5 hours away from their home ?? Surely there would be provision closer to home ??! It seems unacceptable that he would have to make this journey in the first place!!
